Project Labor Agreements

Overview
On July 2, 2024, the Board directed staff to revisit options for a County ordinance on Project Labor Agreements. As a follow-up, staff provided a Memorandum to the Board responding to the Board’s directive on October 4, 2024, and identified key next steps for implementing Project Labor Agreements based on the Department of Labor Project Agreement Resource Guide, the Implementation of Project Labor Agreements in Federal Construction Projects Report, and research from surrounding jurisdictions. Staff recommended that the Board consider budgeting and appropriating funds to procure on-call consulting services, including feasibility studies and PLA implementation services. Staff stated this step is required to evaluate a project for Project Labor Agreement consideration. Once procured, the consultant would work with staff to ultimately bring forward recommendations for the Board’s consideration, and then amendments to the Procurement Regulations to include criteria for Project Labor Agreements (Note: an ordinance is not necessary). The County Executive is directed to work with staff to prepare a resolution for the Board’s consideration, budgeting, and appropriating $300,000 of contingency funding to initiate this process and procure on-call project labor agreement consulting services. The consulting services should include feasibility studies and Project Labor Agreement implementation services consistent with staff recommendations detailed in Directive Response to Resolution 24-30. The County Attorney’s Office is directed to review the information and recommendations for any legal issues. The resolution shall be included for consideration by the Board during the September 23 Board meeting or as soon as feasible thereafter.
