Overview

As we know, there has been a lot of discussion and proposed legislation regarding regulating marijuana and cannabis. Supervisor Bailey would like to explore the ability of establishing a local marijuana tax in Prince William County. As such, without objection, Supervisor Bailey would like to direct the County Executive to work with staff to review: • The County’s legal authority under current federal and state law to implement such a tax, to include any 2026 General Assembly legislation signed by the Governor; • An assessment of potential revenue impacts and any administrative requirements associated with such tax; • Consideration of how peer jurisdictions in Virginia are approaching this issue; and • Any policy considerations or implementation challenges the Board should be aware of. The County Executive is directed to bring back any appropriate recommendations for the Board’s consideration. Such recommendations should, where applicable, include timelines, fiscal impacts, and other pertinent impacts for Board consideration. The County Attorney’s Office is directed to review the information and recommendations for any legal issues. When the research and work are complete, the County Executive should report back to the Board with his analysis and recommendations during a Board meeting or by memorandum, as they determines appropriate.
