Overview

Staff is directed to schedule a Public Hearing regarding: Parcel B, Section 1, Walton Dr., in the Coles Magisterial District. A resident purchased a 2.1852-acre parcel of land at 14114 Walton Dr., Manassas, with the intention of building a single-family home. The property is subject to a note on the plat recorded in 1978, which reads: “This area is to be dedicated to public use. The minor maintenance such as mowing and removal of debris shall be the responsibility of the Homeowners Association.” It is my understanding a homeowner’s association was never established for this subdivision. The property was never dedicated to the County, the County has not accepted ownership of the property. The property owner has requested the County remove the “to be dedicated to public use” designation from his property plat and to formally reject the offer of dedication of the property for public use. Virginia Code Section 15.2-2272(2) and County Code Sec. 25-72(2) provide an option for the governing body of the locality in which the land is located to vacate the designation on the plat following a public notice and public hearing process. Therefore, staff is directed to schedule a public hearing and bring the request back to the Board for consideration, after the necessary coordination with the property owner, appropriate departments, and the County Attorney’s Office.
